Terms of Use hosting "Ocealex" (updated at 03/11/2024)

Our hosting can be used by everyone, but you need to adhere to certain terms of use.

1. The user is allowed to:
   1.1 Create a server and perform the following actions on it:
   a) changing the name;
   b) changes to the content of the server that are not contrary to these terms of use;
   c) server removal;
   d) transferring rights to the server via the "Subuser" function;
   e) connection to SFTP connection by any client using both FTP and SFTP connections;
   1.2 Register or authorise yourself into an account and perform the following actions on it:
   a) view account information;
   b) change password, email;
   c) transferring access to the account to third parties at the discretion of the account holder;

1.3 Ocealex reserves the right to otherwise block any user/server and/or delete a server/account without explanation. Ocealex may also not comment on its decisions to block or remove certain content added by a user for its own purposes.


2. Liability or limitation of liability

2.1 Ocealex Hosting is under no circumstances responsible for: the operability of the server, its content, saving files, actions that are performed on the server, changing the structure of the server, distribution of information to connect to the server, transfer of rights to the server to other persons, manual reinstallation of the server. Responsibility is borne by the server owner (user).
2.2 Ocealex Hosting does not under any circumstances share information about payments made or receipts received.
2.3 All rules must be followed regardless of the user's status.
2.4 The user undertakes to comply with the terms of use and to do everything possible not to violate them. In case of detection of the fact of violation of these terms of use by the user, the user will be blocked until the reasons are eliminated. Otherwise, the user will be permanently blocked (deleted) without the possibility of recovery by the administration.
2.5 In case of deliberate server failure, the user restores the server himself.
2.6 By registering for hosting, you agree to the terms of use and data processing policy.
2.7 Ocealex can delete a user's server if it is not used for an extended period of time.
2.8 By joining a Discord hosting server or other chat room, the user automatically agrees to the hosting terms of use and chat room rules.
2.9 Ignorance of these hosting terms of use does not release the user from liability.
2.1.0 The user declares Ocealex and confirms that he/she agrees to observe changes to the hosting terms of use.
2.1.1 The Terms of Use are subject to change at any time, without any notice to users of changes to the Terms of Use.
2.1.2 The user agrees to the terms of use and data processing policy when creating a support request.
2.1.3 No refunds are possible after purchasing a paid plan and/or additional resources and/or add-ons to a paid and/or free plan.
2.1.4 Even if a user has purchased a paid tariff and/or an add-on and/or additional resources to their tariff (no matter what type of tariff), Ocealex reserves the right to block any server and/or change the number of resources, regardless of the user's status, without explanation.
2.1.5 Site visitors may not copy hosting phrases or descriptions without Ocealex's permission, even if Ocealex is not registered as the copyright owner. (Applies to all visitors viewing the hosting site).
2.1.6 A user may submit a request to delete an account from Ocealex hosting.
2.1.7 Ocealex may change the terms of the tariffs and/or the prices of additional resources to the tariffs at any time and without notice to the user.
2.1.8 Ocealex will issue compensation for loss of user files at its discretion; compensation also cannot be issued without explanation.
2.1.9 If the user has found an error and/or defect and/or bug in the hosting, the user is obliged to report it to the technical support. If information about the hosting flaw is spread by the user who found this problem and it is a threat to the hosting operation, the user will be blocked without the possibility of recovery.
2.2.0 Ocealex can delete a user's server if it has not been used for more than 14 days.
2.2.1 A maximum of 10GB RAM, 400% CPU, 12GB Disk can be installed on a single free server


3. Users are prohibited from:

3.1 Intentionally hacking into the hosting service
3.2 Perform actions such as:
a) creating multi-accounts and servers on them;
b) install any plug-ins that display information about host machines;
c) install operating systems such as: Linux, Ubuntu and others;
d) install game sites ‘donate’ in a non-factory way;
e) install Discord bots in a non-factory way;
f) create many servers and not use them for a long time;
g1) upload photos or videos to the server;
g2) use the server as cloud storage;
h) create accounts with an unacceptable login or email address;
i) create servers with an unacceptable name.
3.3 Ocealex reserves the right to block or delete a server or account without explanation.
3.4 Users are prohibited Part 2:
a) spam the technical support chat;
b) insult technical support staff;
c) create a server with a downloaded version and not use it;
d) create a server and then not use it;
e) use ad blockers; use scripts that block adverts;
f) use VPN servers that block adverts;
g1) insult users of the hosting service;
g2) advertise third-party projects (including your own YouTube channels);
h) mislead the hosting users, including the hosting creators;
i) to have more than 1 account on the hosting, otherwise, if more than 1 account is detected, the user will be blocked in the hosting system without the possibility of recovery;
j) mislead and/or deceive technical support and/or hosting administration;
j) ping the creators on the Discord hosting server;
k) create a constant load for hours on end by using a plugin or anything that causes a constant load. Such plugins include Chunky;
m1) install plugins or software (irrelevant) that automatically contradict the shutdown of servers by administrators, making them unavailable for shutdown and implying automatic server start/restart after forcing and/or shutting down servers on a free plan.
m2) use any software that results in invalid coin accumulation
